The verdict on an appeal that aims to remove Governor Ademola Adeleke of Osun State from office is expected to be delivered by the Supreme Court on Tuesday.

A legal dispute regarding the governorship election that took place on July 16, 2022, in Osun State was adjourned by a panel of five Justices of the Supreme Court. As a reminder, on January 27, the Osun State Governorship Election Petition Tribunal declared Adeleke of the PDP as the winner of the election in a split decision.

 

The three-member panel tribunal led by Justice Tertsea Kume, in its majority decision, accepted a petition presented by the All Progressives Congress (APC) candidate and former governor of the state, Adegboyega Oyetola, who came second in the election.

The tribunal ruled that Adeleke did not receive the majority of valid votes, and the election did not comply with the provisions of the 2022 Electoral Act. The tribunal found that there was over-voting in 744 polling units in the state, which the petitioners, Oyetola and APC, were able to prove. As a result, Oyetola was declared the winner of the governorship race after subtracting the invalid votes. The tribunal also directed the Independent National Electoral Commission (INEC) to withdraw Adeleke's previously issued Certificate of Return.

 

Justice P. Ogbuli, the third member of the panel, dissented and upheld Adeleke as the rightful winner of the election while dismissing the petition filed by Oyetola and the APC. However, an appeal was filed by Adeleke and the PDP, and on March 24, the Court of Appeal overturned the tribunal's ruling. A three-member panel of Justices unanimously agreed that Adeleke's appeal had merit.

 

In addition to nullifying the tribunal's verdict, the Court of Appeal imposed a fine of N500,000 on the APC and its candidate, Gboyega Oyetola, according to Justice Mohammed Shuaibu's lead judgement. Oyetola and the APC were unhappy with the ruling and took the matter to the Supreme Court, which adjourned the case until the parties presented their final arguments before delivering a verdict.
